Terms and Conditions

Teacher/Provider: Marina Afanasenko, Philadelphia, Pennsylvania, USA, marina.afanasenko@gmail.com (the “Teacher”).
Student: the individual who makes the payment (the “Student”).
Course: a group English language learning program (the “Course”).
Lesson: a scheduled group class session (a “Lesson”).
Full Upfront Payment (Prepayment): payment of 100% of the Course fee in a single payment before or at the start of the Course, with a discount compared to monthly payments.
Monthly Rate: the standard, non-discounted tuition fee for one month of the Course.

Format: group online lessons.
Schedule: the schedule is agreed with the Student before the Course begins and is sent via email.
Rescheduling by Teacher: the Teacher may reschedule a Lesson due to organizational reasons and/or force majeure, with advance notice (typically at least 2 hours) and will offer alternative dates/times.

Standard Monthly Rate: set individually for each Course and published on the relevant Course page at marinafriesen.com. The Monthly Rate is also confirmed by email before the Course begins.
Monthly payment option (subscription):
tuition is charged once per month through a subscription that remains active until the end of the Course term;
the subscription must be set up before the Course start date, which is agreed with the Student via email.
Course fee with Full Upfront Payment (Prepayment): set individually for each Course and published on the relevant Course page at marinafriesen.com, and also confirmed by email before the Course begins.
How Prepayment is made: paid in a single payment before the Course start date, which is agreed with the Student via email.
Payment processor: payments are processed through Stripe.
Non-refundable fees: any non-refundable payment processor/bank fees (if applicable) will be deducted from any refund amount.

Lessons are held as scheduled with the Students who attend.
If a Student does not attend a lesson (no-show), the lesson is still considered delivered/held and is not eligible for a make-up, compensation, or refund.

The Student must notify the Teacher of withdrawal in writing by email at marina.afanasenko@gmail.com.
Monthly payment (subscription)
If the Student is paying monthly, the Course subscription will be canceled within 2 business days.
Payment for the current month is non-refundable.
The section below applies only to Students who paid the full Course fee upfront (and received the upfront-payment discount)
Full refund through Week 3
If the Student notifies the Teacher in writing of withdrawal by the end of the 3rd week from the Course start date (inclusive), the Teacher will issue a 100% refund of the amount paid.
Any non-refundable payment processor/bank fees (if applicable) may be deducted from the refund.
After Week 3: refund recalculation (no discount)
Starting from Week 4, if the Student withdraws early:
the upfront-payment discount does not apply, because it is granted on the condition of paying upfront and completing the Course in full; and
the refund (if any) is calculated by recalculating the delivered portion at the standard Monthly Rate.
No refunds after the midpoint (50% of lessons)
Once 50% or more of the scheduled Course lessons have taken place, no refund will be issued, regardless of the reason for withdrawal.
Refund timing and method
Any refund (if applicable under this Offer) will be issued via the same payment method used for the original payment within 45 business days after:
written confirmation of the refund amount; and
receipt of any required payment details (if applicable).

All materials provided by the Teacher (presentations, files, recordings, assignments, worksheets, etc.) are for the Student’s personal use only.
The Student may not share, publish, distribute, or sell the materials to third parties without the Teacher’s prior written consent.

Official notices must be sent by email to: marina.afanasenko@gmail.com.
Requests regarding Course withdrawal and/or refunds are accepted in writing only.

The parties are not liable for failure to perform their obligations if such failure is caused by force majeure events (including, but not limited to, war, blackouts/power outages, natural disasters, etc.) for the duration of such events.
In the event of force majeure, the Teacher will coordinate with the Students regarding rescheduling lessons and/or an updated schedule.

The parties will attempt to resolve any disputes through good-faith negotiations. If the dispute cannot be resolved through negotiation, it will be resolved in accordance with the applicable law.
Governing law: the laws of the United States, Commonwealth of Pennsylvania.

By paying for the Course (in full or in part, depending on the selected payment option), the Student confirms that they:
have read and understood these Terms and Conditions;
agree to be bound by them in full; and
consent to the processing of their personal data solely for the purpose of providing the services under these Terms.
